Why is Health and Safety Compliance in Business Important ?

Work Health and Safety (WHS) issues are important for the Australian economy. The outcome of poor WHS include death, serious injury, environmental damage and associated financial costs. Strong and positive WHS performance can contribute positively to business, workplace relations and productivity.

What are the legal requirements?

The WHS Act is a formal description of health and safety law passed in a state or territory. It is intended to spell out the duties for each group that has a role in health and safety in the workplace. Legislation may vary slightly between states, however they all have common elements e.g. consultation requirements; powers of entry; duties of relevant persons etc

The WHS Regulation is a more detailed set of requirements which provide detail on how certain sections of the Act should be implemented. E.g. confined spaces; construction work, falls, risk work etc

The act and regulations covers ALL WORKERS. So who is a classified a worker?

  • an employee
  • a trainee, apprentice or work experience student
  • a volunteer
  • an outworker (someone that works from home)
  • a contractor or sub-contractor
  • an employee of a contractor or sub-contractor
  • an employee of a labour hire company
